Can anyone advise me on how many things my landlord is doing wrong here and if I should report him?
We have been in the property just over a year now.
He’s a private landlord.
*The tenancy agreement we signed was for 6 months, and he’s never renewed it, or at least has never asked us to sign anything else.
*After asking him numerous times, he still won’t supply me with any info on which tenancy deposit scheme he paid our deposit into, or if he has used one at all (I don’t think he has to be honest). he gets agitated when I ask and asks me what my issue over the deposit is.
*A week before Christmas I told him of all the jobs that I believe need seeing to in the house. These are as follows…..
- Rising damp in kitchen, dining room, by back door.
- Front door has fallen on one side so it doesn’t seal properly and lets cold in.
- We have a lot of woodlice, especially in the kitchen, but also in the front room sometimes and I’m worried my 10 month old daughter will pick them up and try to eat them.
- We get slugs in the bathroom.
- We have a hole in our kitchen wall left from when the landlord’s bro in-law installed a new boiler and the pipe had to be put through to next doors back yard. It never got sealed.
- The fasten on our front gate has come loose and swings around, so sometimes the gate swings outwards instead obstructing the pavement.
- We have a high, wooden back gate in our yard. We are unable to use this as an exit as the top hinge has come loose out of the brick wall. It is no longer srewed in. The gate practically falls down if you try to open it.
Do I have a right to be annoyed and want to get him in trouble seeing as though he’s known about all of these since before Christmas. It is now the end of May and despite mentioning them a few times since, I always get the answer that he’ll sort them but still nothing has been done!
Any advice or opinions will be greatly appreciated.
Thanks.
Thanks for all your answers so far.
I’ve now got an appointment booked with the CAB on wed, and we’ve already got a few viewings on other properties sorted.
JIM - it is a legal requirement for a landlord to put the deposit in to one of the schemes and to supply you with the info within 14 days of you paying it to him!
England/Wales
Firstly, there is no need for the landlord to renew a fixed term contract, you now have a "statutory periodic tenancy" and this can stay like that for ever - or until EITHER of you decides to give notice.
I think you need the environmental health officer at your local council - not the CAB. For example, unless your landlords BiL is a "Gas Safe" plumber it was illegal for him to install a gas boiler.
You can check if your deposit is protected by filling in this form - it will email an enquiry to all 3 companies http://www.snorkerz.com/deposit.html
If it isn’t protected, you might want to use this letter http://www.consumeractiongroup.co.uk/forum/residential-commercial-lettings/232265-trouble-landlord-deposit.html#post2576374
Get the frack out of that place. If he wont give you your deposit back dont pay him rent untill it covers the amount.
contact your local board of health - they may be able to help
It sounds like you have got yourself a bit of a dodgy landlord. My advice would be to definitely go to the citizens advice bureau. They offer a free service and will be completely clued up on what the landlords obligations to you as a tennant are. If you can, take your tenancy agreement and any correspondance from your landlord that you have (if any) and dates of telephone calls etc. They will let you know where you stand will put you in touch with the appropriate authorities if necessary.
Good luck with it all!
Threaten that you will report him, thenmaybe he will buck up his ideas and sort everything out!! Or maybe ever look for a new place…
Go to your local real estate agent and ask their advise and ask them to look for a place for you at the same time
It is really the landlord’s own business what he actually does with the deposit you pay him. He is under no legal obligation to put it in any tenancy deposit scheme. Perhaps he views your constant questioning on this issue as something approaching harassment, and so he feels less inclined to deal with your other problems
Jim - get yours facts right, it’s the law:
